A legally valid New York lease agreement template must comply with these layered legal frameworks, which are among the most tenant-protective in the United States.

Security deposit rules in New York

Under the Housing Stability and Tenant Protection Act of 2019 (HSTPA), New York landlords cannot charge more than one month's rent as a security deposit. This is one of the strictest deposit caps in the country. The landlord must return the deposit within 14 days of the tenant vacating, along with an itemised list of any deductions. Failure to return the deposit within 14 days results in the landlord forfeiting the right to retain any portion of it.

Notice periods and termination in New York

New York's notice periods were significantly changed by the HSTPA. For month-to-month tenancies, the required notice depends on how long the tenant has lived in the property: 30 days for tenancies under one year, 60 days for one to two years, and 90 days for two years or more. Landlords must provide the same notice periods for non-renewal of a fixed-term lease.

Required disclosures for New York rentals

Rent stabilisation and the warranty of habitability

Approximately one million apartments in New York City are rent-stabilised, meaning rent increases and lease renewal rights are regulated by the Rent Guidelines Board. If your property is rent-stabilised, the lease must include a rent-stabilisation rider and the tenant must be offered a renewal lease at the guideline increase. New York also enforces an implied warranty of habitability (RPL Section 235-b) that cannot be waived.
