What is a residential lease agreement?

A residential lease agreement is a legally binding contract between a landlord and tenant for the rental of a property used as a home. It sets out the terms under which the tenant occupies the property: the rent, the duration, the deposit, and the rights and obligations of both parties.

Unlike a commercial lease — which covers business premises and has very different legal protections — a residential lease is governed by housing law specific to the jurisdiction where the property sits. That means the statutory clauses change depending on whether the property is in England, Scotland, California, or New York.

Essential clauses every residential lease needs

A complete residential lease agreement template includes at minimum: the names of all parties, the property address, the lease term (fixed or periodic), the rent amount and due date, the deposit amount and protection scheme, permitted use of the property, maintenance and repair responsibilities, pet and smoking policies, access and inspection rights, and termination terms.

Jurisdiction-specific statutory clauses

The statutory clauses in a residential lease differ significantly by jurisdiction. In England, an Assured Shorthold Tenancy must reference the Housing Act 1988 and comply with the Renters (Reform) Act 2025. In Scotland, a Private Residential Tenancy under the 2016 Act is open-ended with no fixed end date. In California, the lease must address AB 1482 just-cause eviction protections.
